Hoeneß sentenced to 3 years 6 months for tax fraud
... yet keeps his position at the club. Good job Bayern. Way to set a good example.

Re: Hoeneß sentenced to 3 years 6 months for tax fraud
Bayern Munich president Uli Hoeness has admitted to having evaded €18.5 million in taxes after appearing in a Bavarian court on Monday as his tax evasion trial got underway.
The Bayern CEO is accused of failing to pay taxes on an undeclared Swiss bank account and could face time in prison if he is convicted.
Public prosecutor Achim von Engel claimed Hoeness did not fully declare an income totalling €33 million earned between 2003 and 2009, leading to a tax evasion of €3.5m divided over seven separate instances.
Hoeness had filed a voluntary disclosure when first charged in 2013 in an attempt to escape prosecution, but this was rejected by the prosecutor on the grounds that his documents were incorrect or incomplete.
The 62-year-old has now conceded that he has indeed evaded taxes, confessing to a sum totalling €15m more than Von Engel initially charged him with.
"I will have to make significant tax payments, but I am determined to start with a clean slate. I deeply regret my behaviour," Hoeness stated in court.
The trial is expected to last four days, meaning Hoeness is likely to learn his fate on Thursday.

Re: Hoeneß sentenced to 3 years 6 months for tax fraud
personally I think he should see actual jail time.
There's thread I made in the Bayern section too btw which discusses what he's facing and why. Basically if his self-report is judged valid and sufficient he can get away without jail.
As for examples set besides that, I don't really care. If we have a club president who is on probation, I wouldn't mind. It's not like I regarded him as a saint before.
And his presence at the club, in whatever capacity, is very important I'm afraid.

This greedy bastard should face jail time, otherwise the message is that you can evade taxes, just pay them up if you get caught and it's all cleared then.

the highest federal court made a ruling a while ago that anything evaded over 1 million means automatic jail time, no probation possible.
That's why this simply paying up thing doesn't work like that anymore.
However there is this thing with the self report which gives you the possibility to get away without jail, just 'pay up', if you report yourself on your own.
That only works however if you can successfully claim you didn't do it after you are aware you're being investigated.
That's the question the outcome is decided on.
Personally, I agree with you.

Re: Hoeneß sentenced to 3 years 6 months for tax fraud
Actually you can't pay them if you get caught to get away - it is specifically stated that you need to report yourself *before* any action is taken against you - and exactly this is what the trial is about. Did Uli Hoeneß indict himself early and fully enough or not.Art Morte wrote:This greedy bastard should face jail time, otherwise the message is that you can evade taxes, just pay them up if you get caught and it's all cleared then.

Re: Hoeneß sentenced to 3 years 6 months for tax fraud
Well obviously he didn't.
"Hmm, it seems to be all over the press that I've been evading taxes, hmm...
Hello, is it the taxman? Yes, this is Mr Hoeness, I'd like to report myself, I've just realized I haven't been paying all my taxes for several years! Can you imagine that... Oh, you've just reading about that speculation from the papers? What a funny coincidence! So, anyway, shall we call it settled and shake on it? I deeply regret my actions, you know".

It's not quite that clear, as it hadn't been all over the press. There was one report in Stern about a unnamed Bundesliga figure though which probably had him alarmed.

Re: Hoeneß sentenced to 3 years 6 months for tax fraud
So Hoeneß admits to evading €18.5 million in taxes. when previously only been accused of €3.55m.
Cannot see how anyone can defend him, deserves imprisonment.
He has to resign as dodging €18.5 million in tax is devastating negative publicity for Bayern.

Don't understand why these dimwits, who earn millions every year, can't just pay up what they owe to society

Surely he is not staying as president of Bayern after this?

If he gets a jail term, like he should, surely then he cannot? How could he work from jail? "Yeah, we can have a meeting about that potential transfer / commercial deal / Bundesliga matter... if you can come see me in prison. We'll have a glass of water, maybe some carrots, enjoy the scenery, just sit back in our comfy chairs and have a little good-spirited chat about the matter. But not for longer than an hour, that's the maximum visiting time. Whaddaya say?"

The Bayern board decided to keep him last May. We're talking about a vote of confidence from the likes of the Volkswagen CEO, Adidas CEO, Audi CEO, Telekom CFO, and an ex-Bavarian president

Yes, our supervisory board sure is a cabinet of horrors, especially if you add Markwort to that list

So what? He had the cheek to criticize the Malaga owner for not paying bills in 2013 while he was dodging €18.5 million in taxes.
The phrase "people who live in glass houses shouldn't throw stones" springs to mind.

I think there is a difference between criticizing that players have not been paid by a club and personal stuff like the tax evasion (which will likely have him convicted as it should).urbaNRoots wrote:So what? On the upside, he probably won't be moving around much the next couple years, so he wont need to ride his bike everywhere to avoid indirectly funding oil money clubs.
When you think about all the talk he has put out there, the audacity of this guy is too much

Yeah but last May he was only charged with tax fraud, now he has confessed to evading. That IMO is a massive difference. He should resign if he cares about the club more than he cares about himself.

Both situations involve money not being given to a party that is owed it..............can't see much difference tbhrwo power wrote:I think there is a difference between criticizing that players have not been paid by a club and personal stuff like the tax evasion.urbaNRoots wrote:So what?
