Because the defendant in such a case would have enough $$$ to pay for a proper lawyer. The hat-shop lady's salary probably won't cut it if she wants a fancy lawyer.Zealous wrote:Isn't there a club in Argentina called Arsenal?

The club was founded in January 1957 by brothers Héctor and Julio Humberto Grondona, inspired by the English club Arsenal. The team's shirt colour is light blue with a diagonal red band (similar to the shirt used by River Plate). The colours were chosen as a combination of the two older clubs in Avellaneda – Racing (light blue) and Independiente (red).
that the Russian one are acknowledged on the Arsenal site as being inspired by us...

Still they are making more money off of your image than a old lady in Spain. LOL
If I were in charge of Arsenal I'd fire whoever gave this the go ahead. Picking on old ladies only makes Arsenal's haters feel better about making fun of them.
Deal with that bro.

Re: BREAKING NEWS: ARSENAL WIN SOMETHING
Anyway
Simon registered the name of her shop before she even opened it in 2007 despite protestations from the club
So she was warned that it could end up getting messy and she still went ahead at did it anyway. Sorry, but people are acting like the club just picked her out of the blue when in actuality, she was warned even before she opened shop and registered the name
Again, not condoning it, but at the same time, don't act like Arsenal are picking on the weak and frail for no reason

Re: BREAKING NEWS: ARSENAL WIN SOMETHING
Any football club or large/small company would do this. IT's the principal of it more then picking on some small shop. The thinking is if you let one person do it, where does it stop.
These companies have Lawyers on staff and there job is pretty much to do this sort of thing when they are not getting sued by small business'/people looking to scam money off of them. It's a two way street and Arsenal have done nothing wrong.
BTW, i'm surprised they won as they must have had a bunch of legal president on there side as I'm sure any judge would rather rule in favor of the small business (underdog) then the giant company especially when the names aren't even spelled the same and I'm sure there not using there logo either.

While I understand your point that doesn't really make it any less bad IMO.
You could argue they had no right to even threaten legal action in the first place. (Speaking in a real world context not a legal one)

Re: BREAKING NEWS: ARSENAL WIN SOMETHING
Researching it in more depth and reading up more on the matter, the issue Arsenal have with the whole thing is because, aside from hats, she also sells shoes and footwear with the Arsenale name on them
You don't think that if a store in Bruges was selling trainers and sports shoes with Real Madride or Manchester Unitede on them, their lawyers wouldn't come down on them like a ton of bricks?

Re: BREAKING NEWS: ARSENAL WIN SOMETHING
I won't refute that claim because I know that's a plausible scenario, but then again it's still rather petty.
Again speaking in the real world context not in a legal one. As far as that goes Arsenal were well within their rights it seems.
But even if they had a decent claim it's unneeded bad PR IMO.

Re: BREAKING NEWS: ARSENAL WIN SOMETHING
When money is concerned, the real world takes a back seat to greed and gluttony, unfortunately. Ideally, this shouldn't be a huge deal, but the moment the penny drops and people realize they could potentially be losing money over it, they go from Dr Jekyll to Mr Hyde quicker than you can say see you in court

This makes no bloody sense.Lex wrote:Researching it in more depth and reading up more on the matter, the issue Arsenal have with the whole thing is because, aside from hats, she also sells shoes and footwear with the Arsenale name on them

"Arsenal" is a generic name used by many people all over the world - in business and personal context. To take patent on such is ridiculous. Suing someone for using a "Manchester Unitede" name for their shop makes more sense because United's name is distinctive, unlike Arsenal's.
Chances are - because of Arsenal's generic name - that people don't even think about the football club Arsenal when they visit that shop. It would make more sense if the shop took advantage of the name by selling football-gear. Fortunately for them, their primary business is to sell hats and occasionally, footwear/clothing.
Believe it or not, there are people out there who don't know about Arsenal nor do they give a sh*t about football. How are they going to prove that people associate the hat-shop's name "Arsenale" with a football club situated in another country named "Arsenal"? And that the shop is taking advantage of Arsenal's brand?

Disgraceful.... Either you're not a football fan and don't know who Arsenal FC are, or you're a football fan and know that the football club is not spelled Arsenale and has a gatlin gun as their logo
What a joke

Re: BREAKING NEWS: ARSENAL WIN SOMETHING
So Arsenal is afraid people will confuse Arsenal Football Club with a tiny hat shop in Seville, who btw. has the name ArsenalE, with an E in the end. What a joke. I would be more worried about a certain Argentinian club with same name. How come Arsenal haven't filled a lawsuit against ''Arsenal Fútbol Club'' also called ''Arsenal de Sarandí''?
