Swedish Rape Laws
I just read a news that in Sweden a 13 year old was raped by 19 year old. Yet the latter only got 75 hours of community service as he was merely taking advantage of her and not rape. Their age of consent is 15 .
Wtf is going on in that part of the world .

Re: Swedish Rape Laws
You don't really know the whole individual situation. 19 year old can be final year high schooler and 13 year old can be 8th grade high school student. Both might have had something with each other on a school trip. Then the mom of the girl freaked out.
There is a whole lot of nuances between Monica Bellucci Irreversibel movie type of rape and 2 school kids with the wrong age fingering each other.

No 19 year old should be with a 13 year old period. Doesnt matter if they are at the same school. Shit's gross, and really just a guy taking advantage over a kid who does not know better.
What can a 19 year old even do with a 13 year old besides terrible sex? Go see a PG-13 movie?

Re: Swedish Rape Laws
Whether it's morally okay is not the topic though. Topic is "rape law". My answer was: There is no single law that you can apply to every situation. A 40 year old man intruding school then violating a pupil in the toilet requires a different sentence than a school boy making out with a minor school girl. One would justify 10+ years in jail, the other might get 75 hours of community service.

Re: Swedish Rape Laws
The age of consent in Sweden is 15, as specified by the Swedish Penal Code, Chapter 6 (On Sexual Crimes). The age of fifteen is referred to several times, for example in Section 4, which reads: "A person who has sexual intercourse with a child under fifteen years of age or who with such a child carries out another sexual act that, having regard to the nature of the violation and the circumstances in general, is comparable to sexual intercourse, shall be sentenced for rape of a child to imprisonment for at least two and at most six years."
There is a position of trust rule in which the age of consent is raised to 18. The section mentioned above continues: "The same applies to the person who carries out an act referred to in the first paragraph to a child more than fifteen years of age but less than eighteen years of age and who is offspring to the perpetrator or in the perpetrator's care or in a similar relationship to the perpetrator, or for whose care or guardianship the perpetrator is responsible due to the decision of a government agency."
It is not legal to have sexual intercourse with related adults either, but the sentences for that (up to two years) are considerably milder than those for rape of a child (two to six years, four to ten years if aggravated).
There is also a close in age exception (Chapter 6, Section 14) "...not sentenced if it is obvious that the act is no violation of the child considered the small difference in age between the person who carries out the act and the child and other circumstances." In a verdict of 30 March 2007, the Supreme Court found that a 17-year-old boy had not committed a criminal act by having sexual intercourse with a girl 14 years and 7 months old. (Case B 415-07)[126]
The Swedish age of consent also applies if the act takes place outside Sweden but the elder person later goes to Sweden. The elder person doesn't have to be a Swedish citizen or resident, but could be a tourist on a temporary visit. This is regardless of the age of consent in the country where the act took place.[127][128]

Re: Swedish Rape Laws
if you read about it why don't you share the link with us? I just googled and didn't find any recent news that sounded anything like this case. I mean if we're supposed to discuss this case we should probably at least know what it really is about?
