I dont know how the law works in France but wouldnt the telephone conversation be enough to convict him without Valbuena's likely influenced testimony??

He pretty much admits his involvement with his choice of words and such incriminating evidence is pretty strong in a court of law.

The only way Benz gets away scot free is if the judge was bribed or if Valbuena changes his mind and tells the court it was all made up in which case he wil be charged with wasting tax payers money

That's not what the phone conversation said... the media just took the juicier parts out of context.

What he said was:
- These are bad guys and they're not going away. You need to take it seriously.
- You have to decide whether you and your family are ok with the "buzz" of this tape if it comes out. If you're ok, screw them and go to the police.
- If you want to pay them off, then i have a friend who can handle it for you. Don't deal with them directly. He knows what he's doing.
- Whatever Valbuena decides... Benz told him this is all he can do for him. He's not going to go any further (that part is conveniently not being published.)

Intent is the important factor here. Was his intent to help Valbuena or blackmail him too? That's why the judge wants to talk to Valbuena... he has to tell her whether he felt Benz was helping or pressuring him.

The charge is accessory to blackmail... not blackmail. So they have to show that Benz was looking to assist Valbuena's blackmailers. So unless Valbuena tells the police that Benz pressured him, there's no case.

This is only dragging on because they needed to compare what Benz said to the police with Valbuena's testimony. Valbuena is scheduled to be question on November 20th... so they can't clear Benz until then.

my guess is that its not with his wife (just my guess)...it hasn't been mentioned who the woman in the video is. nobody's mentioned who the woman in the vid is. but now obviously his wife knows, the vid itself could be even more damaging than jus knowing there's a vid out there....maybe he did things his wife wouldn't let him do, or things he wouldn't do with her...who knows. or maybe its his wife and he doesn't want it out for her sake....most people don't want everyone seeing everything their wife's got
