Most of you probably know by now that Santos have officially said no to Real Madrid's offer for Neymar. They offered to pay the whole 45m, and we still said no. What some of you might not know, is that their offer was to take Neymar now or in January, and we said no to both(!).

I think it's interesting, because a lot of people have settled for the supposed fact that Neymar will be leaving Santos during the next window transfer, but our president really wants to keep him, because we our club turns 100 years old, and we want him there for the celebration and for the next Libertadores.

Here's what he said:

- It wasn't Neymar who said no [to Real Madrid's offer]. It was Santos that, on a letter, wrote a formal response to Real Madrid's offer, which were proposing us a negotiation with two alternatives: giving him to them now or in January. Neither one of them interested Santos. I respectfully told Real Madrid's president (Florentino Pérez) that the offer we received did not interest us. Neymar has already stated that he won't want to leave until the end of the year. Santos want him in Japan (Club World Cup), and he wants to play. And the alternative of him leaving at the start of next year doesn't interest Santos either, as we intend to have him at the next Copa Libertadores, and it will be the club's hundredth birthday, so he will be one of the most important figures at the celebration. Then at the middle of the year there's the Olympics, so I hope he will be champion with Brazil, as a Santos player.

Some days ago, he also said this:


- We have absolutely no intention of disposing of Neymar. We are showing that Santos aren't a mere youth center for European football. Neymar is happy here, he has the dream of being world Champion.

A question (or 2): Does Neymar contract have a buy out clause? If yes, any team meets the buy out clause, does Santos have any say?

Santos keeping him for one more season is to his benefit, he can keep developing. It's what i had hoped would happen, but it's also going to be his last season, so i wish him to win the serie A and the libertadores again. Next summer we will most likely sign him and be done with it. All parties benefit.

This is great, he gets to iron out all his issues and develop for a year in Brazil, then come next summer, hopefully saving us a few million at the same time. Looks like everything is working out in the end.

There is no universe where Neymar is actually worth 45 million. No way.

Blessing in disguise for Madrid and really the way Santos have been kicking and screaming about how awesome they are for rejecting the bid (as if they themselves who rejected it when it was actually Neymar himself that said no) screams of insecurity.

Anyway if Neymar really wants to stay in Brazil forever than he's free to do so but the only thing that will really suffer is his career.

At least Pele has three world cups and 1000 goals to fall back on as an argument in best ever debates. Neymar probably won't have that luxury.

2 - Santos did reject it. What are you basing your comments upon? Neymar didn't want it either, but even if he did, Santos are not forced to let him go, even if Real Madrid meet the 45m. It's in the law, and Santos have rejected it.

3 - Insecurity? Do you know anything about the world of football? About how European clubs with money just take South American players away from our clubs and countries as soon as they look interesting? It's not Santos, the entire Brazil and South America are proud, because it is a rare thing to happen. Look at other clubs, selling their best players to survive as soon as they get good, and Santos are doing the opposite. And yes, it's incredibly difficult, and he probably will leave us during 2012, but at least we kept him for longer than the usual.

4 - Neymar winning the WC with Brazil in 2014 might change everything, if he still is with Santos.

5 - Pelé doesn't have the 3 WCs and 1000 goals as an argument , in fact he was injured at one of those, and officially he doesn't have 1000 goals. The arguments for his talent are others.

6 - Neymar is 19, you dont know what luxuries he'll have.

Santos rejected an offer that, frankly, they have no right to reject.

There a FIFA rule that you cannot randomly offer a foreign player under 28 that is on his first 3-year contract without club consent UNLESS there's a succinct buyout clause and the player accepts the offer. According to AS, Neymar has already signed a 5-year contract that has a 12-month period to trigger with Madrid. Madrid was trying to get Santos to agree to the sale so that they didn't need to get the player involved. But Santos' president has an election coming up and wants to either a) keep Neymar or b) have Neymar become the villain.

If Neymar breaks the contract + either does not sign with Madrid or signs with another club by next summer, there's a significant damages clause.

Basically, it's all in Neymar's hands when he wants to move. If we pay the release clause and Neymar approves it, he's ours. Regardless, he's ours unless he wants to go to another club and that club agrees to pay us the damage clause on his behalf.

The damages are reciprocal... so Madrid is obligated to follow thru as well.

@sportsczy I've found it, and it seems that you misunderstood some things. Here it is:

- When a player under 28 has signed a contract, there's a 3-year protection from foreign clubs, which means that even if they do pay [in this case] the 45m, the club doesn't have to release the player.

- Neymar signed a new contract with Santos last year, 2010, which means that until 2013, Santos don't have to sell him, even if the buy-out clause is met.

- When the player is over 28, the protection thingy is only 2 years.

Santos will only allow Neymar to leave if they want the money. And, of course, they wouldn't want to keep a player unhappy, but really Neymar would possibly be okay with staying in Brazil until 2014. The thing is that I don't think Neymar could have signed any type of contract with RM when he just signed one with Santos for 5 years last year. That would be illegal, as far as I know.

Back in 2007, Bayern bought Breno from São Paulo for 19m. His price tag was 18m. Do you think Bayern paid 1 million more because they liked São Paulo? No, because the Brazilian club were aware of the rule and asked for more.

You can sign a LOI that creates a mutual option without breaking any laws or creating bad blood. Typically, you would have the actual contract be an exhibit to the binding LOI. Just shows mutual commitment. If it's for the release clause amount, what does the club have to complain about? You don't put a release clause in a contract for show... it means that the clause allows a player to trigger a sale if a specified amount is met.

The only catch is that the player needs to evoke the release clause. A foreign club cannot. If Santos put such a clause in a contract, Neymar agreed to it, both parties signed... and it was illegal in Brazil, Santos and Neymar are both breaking the law. I doubt they would do that.

Well, I guess that when you sign the contract, there's gotta be a buy-out clause there, so if Santos want to, they can still sell the player, and after 3 (or 2) years, it's obligatory. I don't fully get it either tbh..

Either way, I sadly don't think Neymar is going to be with us after summer 2012... but I still have hopes Razz

I've done enough business in emerging countries that circle-jerking is not new to me at all lol... but it's always interesting. Lawyers get paid for things that have absolutely no utility. Just there for them to make money.
